• Application means the software program provided by the Company, downloaded by You on any electronic device, named Grately – Daily Uplift: Speak Daily Affirmations for Mental Clarity.
• Application Store means the digital distribution service operated by Apple Inc. (Apple App Store) where the Application was downloaded.
• Affiliate means an entity that controls, is controlled by, or is under common control with a party, where "control" means ownership of 50% or more of shares, equity interest, or other securities entitled to vote for election of directors or other managing authority.
• Country refers to Switzerland.
• Company refers to Grately.
• Device means any device that can access the Service, such as an iPhone or iPad.
• Service refers to the Application.
• Premium Features refer to the enhanced services or access to premium content offered by the Company to You, including themed rooms and additional customization options.

2. Acknowledgment

These are the Terms and Conditions governing the use of this Service and the agreement that operates between You and the Company. Your access to and use of the Service is conditioned on Your acceptance of and compliance with these Terms and Conditions.

The Service is designed to help you develop a daily affirmation practice through spoken rituals supported by immersive visuals and soundscapes.

3. Premium Features

Premium Access

The Service offers both free and premium features. Premium features include access to themed rooms, additional customization options, and enhanced visual experiences. Premium features are available through one-time purchases or subscription plans as offered through the Apple App Store.

Purchase Cancellations

All purchases are handled through the Apple App Store. For refunds and cancellations, Apple's refund policy will apply. You can manage your purchases through your Apple ID account settings.

4. User Content and Privacy

Your affirmation practice, progress data, and personal preferences remain private and are stored locally on your device. The Company does not collect, store, or have access to your personal affirmations or voice recordings.

5. Billing

All billing for premium features is handled by the Apple App Store and is governed by Apple's terms and conditions. The Company does not directly process payments.

6. Limitation of Liability

Notwithstanding any damages that You might incur, the entire liability of the Company and any of its suppliers shall be limited to the amount paid by You through the Service or $100 USD if no purchase was made.

7. Governing Law

The laws of Switzerland, excluding its conflicts of law rules, shall govern this Terms and Your use of the Service.

8. Changes to These Terms and Conditions

We reserve the right, at Our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will make reasonable efforts to provide at least 30 days' notice prior to any new terms taking effect.
